So my buddy called me up today and told me his son has decided to become a Pastafarian. He goes on to tell me that his boy decided to wear a pirate hat with a Jolly Roger on it and and an eye patch. When told to take his hat and eye wear off he declined on the basis of freedom of religious expression. He has now been suspended for three days.
Should he sue?

Yes.
Get the civil liberties people on his side. Are there any Muslims or Jews around? Are they able to wear special religious dress at school? Are Christians allowed to wear crosses?

Sue the crap out of them. He'll lose, but the legal reasoning will likely provide us with great moments of shame and derision that can be our gift to future generations!

Yes.
Though, not (necessarily) on "religious" grounds.
There is nothing inherently disruptive to the pedagogical interest of the school by wearing a pirate hat with a Jolly Roger on it along with an eye patch.
It is better served as a freedom of speech issue, in my view, not a freedom of religion issue.
I love his creativity and initiative!
